struggling on spouse visa

Hello everyone,

Have a question regarding sponsoring my husband to the US from VN. He used to live in Germany for 8 years up to 2009. The last 3 years in Germany he basically lived as an illegal immigrant because his visa expired. He got exported back to VN. After that, we got married. Can I still sponsor him to the US? Would it affect his police record from Germany(1 of the required docs)? Is it consider a crime and would it cause him not able to come to the US? Please help. Thank you all very much!

PS: I'm a US citizen and we recently have a child together.

Thank you! That eased me quite a bit. But also on that note, when you said it might affect the German Police Cert, does that mean they might not issue one to my husband or when it does get sent through, he won't be able to pass the interview?

I don't know how the Germans will react to granting a police certificate to one who was illegally in their country. They may have no issues with it. I have no idea
