Ok part one of the information.

We submitted AOS May/2011 due to a complication it lasped 90 days. We had to start all over. Not a real big deal but here we are now.

We resubmitted July 25th 2011 my wifes 1 year medical exam expired 8//10/11 we received NOA saying USCIS was processing before 8/10/11 but received a RFE saying we need to do medical exam again. Well we called USCIS and they didn't explain anything they only told us, well you have the RFE resubmit the medical exam.

So we called the list of Doctors in the area and they are all saying between $80-$400 to do this. Okay this whole thing is stupid, but we have planned for this and my Wife is on my insurance, so we call the in-network providers and they are all saying they wont submit this to a insurance claim.

Does anyone know why this is? Are they doing something shady with this Civil Surgeon Status where they wont submit to an insurance provider ( which by the way I have talked to and they say they do and will cover this ) and request this be paid outside of insurance?

We live in Texas and use blue cross blue shield who covers this yet every Doctor is insisting on being paid out of pocket.

So the short version is:

USCIS sent RFE saying we were outside the 1 year even though we weren't.

Refused to discuss it and only said do what the RFE says.

Doctors are refusing to cover this or submit this to a provider that says this is covered within their network.

Anyone else experience anything like this or have suggestions?

Well, none of the civil surgeons will take any insurance. This is given that you HAVE to pay out of pocket. I had the same situation (similar). Basically, there is no choice:

1) You have to go for medical exam

2) You have to pay out of pocket..

You say that BCBS said they cover it, what did you tell them? Did you tell them this was an immigration medical and includes a TB skin test, and shots? Insurance doesn't cover it. They might TELL you they do but I've been told lots of stuff that's a lie.

it's expected it'll be out of pocked.

As for the date, you were VERY close to the expiry date so it makes sense that USCIS wants you to redo it. In fact it was so close it would say to me that you're trying to hide something by making it "under the line" and that's probably why they're insisting on it.

Anyway you don't really have a choice. Don't do it risk denial and having to reapply (and re-pay), or do it and yes lose the money but you're safe.

If your insurance company says they'll cover it then pay the civil surgeon out of pocket and send a claim to the insurance company. The civil surgeon isn't going to bill the insurance company for you.
