From F2A to F2B??? SO SAD!!!

Hi guys...

Greetings of peace...

I would like to share my case to the VisaJourney Family of mine. Well here it goes, my LPR mom petitioned me and she was able to file my requirements 3 days before my 21st birthday, on that day she was very happy and excited and she called me right away and with the sound of her voice she sounded very hopeful because she was able to file me before I turned 21, not knowing that by the time my visa will be available I will age-out already. Can anyone please enlighten me if there's still hope that I can still retain my F2A status or not? And if not, it hurts to accept that they placed me under F2A knowing that by time the visa will be available I will age-out already, its kinda sad because its like we were given a false hope because we really don't have any idea about age-out processes and no one explained it to my mom.

There is a calculator around to see if you qualify for the Child protection.

It won't help the OP. Her age froze on the day her petition was accepted, but she began aging again the day her petition was approved. The CSPA allows a beneficiary to deduct time spent waiting for the petition to be approved, but doesn't allow them to deduct time spent waiting for the priority date to become current. She's aged out.

sorry but i think u have to wait for long time undr f2b....or you may be transferred to f1..but i think u cannot sustain status under f2a...bcaz f2a petition is approved within 5 to 7 months depending on service center...so i dont see that u will able to sustain under f2a....sorry but after approving ur petition....us age is considered and u have only 1 month...pray with in 7 to 8 month cutoff date moves to 2011 or beyond otherwise u cannotsustain f2a...take care..

It's unfortunate that you aged out. CSPA will not help you since the I-130 was filed 3 days before your 21st birthday. There is nothing you can do, you have aged out into the F2b category.

false hope wasnt given my friend... if an application is received when the applicant is short a few days/weeks from the birthday in your case it had to be coded as F2A .. how could they place you in a category that you are not qualified to be apart of..? Now that you are 21.. the necessary adjustments were made. it'll be done for you in no time.

The Link to the calculator is broken, How can I use this against my sister? She is going to turn 21 on November, 2011. Her PD is 09/2009. and Lets assume that PD is Current on 12/2011.

from what im looking into with your timeline.. she has one more year... uscis took approx. 12 months to approve your case.

from what im looking into with your timeline.. she has one more year... uscis took approx. 12 months to approve your case.

No. She has 3 days after the I-130 is approved. Her mother filed the I-130 three days before her 21st birthday. Her age "froze" when USCIS had an unapproved I-130. She started aging again once the I-130 is approved. Three days after her I-130 was approved, her CSPA age turned 21. Unless her PD became current during those three days post approval (which is highly unlikely), her CSPA age is now over 21. She belongs in the F2b category.

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

Hi guys. Im so sorry if i posted my concern here. I just really need help from you guys.. Im a newbie here..
Here's my concern...
Before I turned 21, my mom who is a green card holder filed an I 130 petition for me and Im assumed its F2A when my mom filed it... AND after 1 year and 8 months the USCIS shows POST DECISION ACTIVITY on USCIS.GOV saying...
"On June 20, 2013, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.
Now, Im very confused! and worried! because when my mom filed the Petition for me I was under F2A... and now that the petition is approved and Im already 22 and turning 23 on november , will my category automatically changed to f2b? thats a long, long, long wait!!! and will the CSPA can protect my status to remain as f2a???
I checked the VISA BULLETIN for JULY 2013 and my PD is OCTObER 5, 2011 and if it is still under F2A, my PD will be current next month right???
By the way...
-I received an email from USCIS the same message I saw when I logged in at USCIS.GOV in the case status.
-My mom received the letter after 3 days and contacted USCIS, uscis told my mom that NVC will send letter to her..
-and Just today JUNE 27, 2013 i received an e-mail from USCIS saying...
"The California Service Center (CSC) no longer has jurisdiction over this petition. This case was approved and notification was mailed to the address of record on June 20, 2013. This case will be forwarded to the National Visa Center. Please send any further correspondence to the following address: NVC, 31 Rochester Avenue, Portsmouth, NH 03801-2909. Direct any telephone inquiries to (603) 334-0700.
If you need a duplicate copy of your Approval Notice, you may file Form I-824, Application for Action on an Approved Application or Petition, with fee.
"I DONT KNOW WHAT TO DO NOW, AND Im very WORRIED AND CONFUSED!!! PLEASE HELP!!!"...
