Can I delay sending in the I864 when i send in my AOS paperwork

Hi there. I would like to know if I can delay the sending in of my I864 when i do finally get the chance to adjust my status. I know I am jumping the gun a bit as I don't even have USCIS approval for my K1 visa yet, but I was reading a post today from a woman who had got her K1 and arrived and married, but can't afford the cost of adjusting her status.

I would like to know if I can submit my AOS and work authorisation paperwork without my I-864? Will this delay processing of the work permit? I figure my AOS would be RFE'd if i don't submit it. My fiancee's parents have agreed to co-sponsor me, but if I could I would like to be able to be employed and have my info on the form rather then theirs, if this is possible.

Does anyone know if this can be done?

You would have to work 40 credit points before they will consider your income. Plus i am sure there is some time frame where you have to reply to the RFE otherwise its an automatic denial and you would have to leave USA.

I might not be 100% correct but someone will confirm it for me.

In the past, an RFE on the I-485 that is issued before the approval of the EAD, will suspend processing on that application as well.

I have heard many times the I-485 is or has been rejected immediately if the I-864 is not in the initial packet

If you did that they'd either turn your filing around for not being complete or send you an RFE and give a deadline in which to respond to it or lose your filing. Best to wait until all is in order.

I would wait till you were squared away and submit it all together RFE much slower than being prepared..

If you don't send I-864 they will issue RFE. While they wait for your RFE response, your applications are on hold (both AOS and EAD). EAD most likely won't be approved and issued until you submit missing I-864.

My Immigration Journey:

K1: June 2010 - December 2010

AOS: April 2011 - June 2011

ROC: April 2013 - August 2013

Naturalization: March 2014 - August 2014
