Hi i was just curious how transcipts from the irs are done up when you file jointly. does it include your income separately from your husbands or is it together? sorry but i've never been married and never filed jointly and never ask for a transcript. just asking because my sister can sponsor with her income but she is saying her ex is being a jerk right now so we would not be able to include his income to meet the guidelines.

she can get a statment from her employer though with her salary information is this doable? which income will they go by? the irs forms or the employer statement(much higher)?

The tax transcript is based on the tax return your sister filed. Since she filed jointly with her husband (now ex-husband), both of their income will be on the tax transcript. She will need to figure out how much of the income is attributable to her. She cannot include her ex-husband's income on the I-864 - she does not have access to this income any longer and he is not signing any I-864 or I-864a.

Your sister may need to include paystubs to substantiate her income listed in the employer's letter. This income may be considered in the overall approval of the I-864. There is no way of knowing if this is enough.

In this case, she'll have to include the tax transcripts as well as copies of her W2s. This will show which portion of the income is hers and which portion is her ex's. Since her ex won't be signing an I-864 or anything, NVC will just use her income.

Employment letter and pay stubs are optional, but always a good idea as proof to show current income.
