Hi i am trying to find out if my sister who says that she is in process of divorce but separated from her husband has to include him on her household size. they are living apart but they have filed jointly for previous 3 yrs? Can we just include some proof of pending divorce and leave him off?

No, she has to include him in the I-864 because he is still her husband until the divorce is final. Once the divorce is final, she can submit an amended I-864 to exclude her ex-husband in her household count.
