My name is Daniel and I'm a U.S citizen that married a Canadian, she was deported at the border when she was trying to cross because she lie giving that she got nervous. She doesn't have a crriminal record and now we been married for almost a year. We applied for the petiton and was approved and now we doing the process with National visa center. My question is regarding I-212, where do we need to file since she lives in Toronto? (Pearrson?) Aand how long would it take to hear if approved? Any help please. Thanks.

I don't think that she would be deported at the border. I think in all likelihood she would have been denied entry. Double check with your wife and see what is on her passport for that day if anything and then you will be better informed as to how to proceed.

I am sure someone else with more experience will chime in with more advice.

As far as I know, being deported requires you to be in the USA. Sounds like she just got denied. If she just got denied, without any kind of ban, then you don't need a waiver. Get your wife to look at her passport and the stamp inside. Or if she received a paper, to check that.

After we sent our I-130, I got denied TWICE at the border. No waiver needed. Wasn't even asked at the interview about it.

Get an immigration attorney to evaluate this, it might be misrep or nothing. Find out before the interview.

You right she was not deported, she was denied entry but they prohibit entry for a period of 5 years. We think in applying for a waiver I-212 at time of interview in the counsel. what you think?

Well, if they gave her a ban, then yes, I believe you'll still need a waiver. Sorry :(
