what doesw my fiance need to bring her daughter here

My Fiance daughter has her fathers name on her birth certificate, the father never seen the daughter and never pay support and they were never married or lived together, does she still need a letter from him saying the daughter can migrate here to the USA with her? we are worried that we wont even be able to find him never mind get him to sign a letter in time for the Visa.

Generally, a child needs the permission of both parents to obtain a US immigration visa. The non-immigrating parent would need to supply a notarized document allowing the child to immigrate to the US.

The US Embassy will follow local custody laws. If local laws states that a single mother has full custody, then it may not be necessary to obtain the father's permission for the child to immigrate. You will have to investigate local laws.

If the non-immigrating parent's permission is required and you cannot obtain it, you will need a court order allowing the child to be removed from her home country and to immigrate to the US.

Please fill-out your profile. In this case what country she is coming from can make the difference between night & day.

In the Philippines this is not an issue as the father has no paternal rigths to any child born out of wedlock, see the link in my signature.

FWIW, using words like "full custody" are meaningless unless the custody order also terminates the other parents parental rights.

That's depend on the Phillipinos laws about custody I guess, I mean when the parents are not married, do they still have the joint parental authority?

In Europe, even if you are not maried you do.

I had to have the agreement of the father (the letter allowing his child to leave the country) or the family judge's decision.

That's what I had since the father did not want to allow his child to leave with me;

She needs a letter from the father or a court decision for her interview. Since the father does not show up for anything, it should not be too hard. It is just that it takes times to go to court, so she should ask an appointement to the family judge already.

My 2 kids's father's name was on their Birth certificate even though we were not married. I did not have any problem bringing my 2 kids here .

- just make sure your fiancé will provide CENOMAR father daughter.. And you can provide letter of consent as well just in case. :-)
