My Fiance who is from the Phil, Has a daughter whos fathers name is on her birth certificate, they were never married, never lived together and he never paid support or had any interaction. I have been told this will hold up the visa process. We sent in our packet June 22, 2011 It was received and we are currently awaiting the next step, I believe the noa2.

Most Embassies require a notarized letter from the father giving permission for the child to permanently live in the US>

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

Since this is the Philippines, follow the link in my signature. This will not be an issue, the father has no parental rights so nothing will be needed from him!

Thank You guys, and yes I did fill out the rest of the profile. The reason we are concerned is her daughter has a different last name, obviously as she has the fathers last name, so we are thinking what would prevent someone from saying they were not married, even if they were ( which is not the case here), but I would think the visa issuing folks would want some kind of proof that she was never married given the fathers last name is on her daughters birth certificate.

I mean if they already know that in the Philippines an illegitimate child even of they have the fathers last name, is still in the custody of the mother I guess the question is still how does she show this? I'm sure they must need some kind of document or letter or something. we are just trying to cover all the bases so that there are no delays. And really were so in love none of this makes us lose sleep, just want it to go smooth :) we are very appreciative of the reply also.

Its nice to see so many people who have either gone through or are going through this. And for sure its not easy, being a former marine I know all about the hurry up and wait routines with our government.

Her CENOMAR will show that she wasn't married before. Also the Birth Certificate should show that they weren't married.
