Prosecutors are IDIOTS. They don't want to go to trial because they are too lazy and too stupid to win, if it wasn't for the judiciary (who are primarily ex-prosecutors themselves) they'd never win. Diversion is latin for haven't got a chance of securing a conviction. What'd they pinch you for?

As opposed to defense lawyers who only have to prove a reasonable doubt, the standard is much much higher for prosecutors, as it should be. Some prosecutors are only interested in their next job, or the one after that, so they will only take on cases that are a slam dunk win. Those will offer you a deal on a lesser charge as a means to maintain their conviction ratio.

If you can afford a real lawyer and not some idiot public defender than it's in the bag. But if you get some worthless public defender your screwed whether your innocent or not. Things Iv'e learned in life is to never take the deal, and never talk to the cops.

Public defenders aren't poor attorneys if you live in a more densely populated area. The pool in which they have to draw from is simply much larger. Most attorneys who do public defense work are well established attorneys who simply do it to fulfill community outreach programs of their firm, or are looking for a more reliable payee. I have heard that out in the sticks, the only public defenders are people too old, or too unskilled to cut it in a real courtroom. Sucks for those people. Good advice, don't talk to the police, if you've done something wrong that is.
