It's always alarming to read of denials.

I think what might 'help' others is seeing the proof of what we have always read - the requirement to meet in person is rarely waived.

I remember a similar situation with a member - I don't recall her name - but she was also denied at the Service Center level for not having met face-to-face in the last 2 years.

She gathered her courage and flew to meet her fiance. As nearly as I know they were approved when the second petition was filed.

It also helps to realize that just because someone who filed around the same time you did got denied, that there is not now going to be a waive of denials. The hardship apparently did not meet DOS requirements to be waived and the case was most likely legitimately denied.

Unfortunately for jabree.

Well, I'm glad we got that cleared up.

My concern was that other members might read of this Service Center level denial and start to fret even more about their pending petitions. I did read a thread this morning where a member referred to this thread - she received her approval today and said that she burst into tears when she saw the notice in her e mail - that she had been even more worried since reading of jabree's denial.

I was worried about that as well. And reading that thread I remembered it... I was at work when I read it for the first time so I couldn't post a reply, but I still remember what I was gonna post though. And even though I know it won't make a big difference since she got denied, it can help someone else.

When you don't meet within the 2 years required, you have to let them know and show hardship from both sides! I know she has a medical condition that doesn't allow her to travel but maybe, and that's a big maybe as I'm not an immigration lawyer, they also wanted reasons on why he couldn't visit her where she lives (or even a closer country that she could go to, like Canada...). I take this from reading this board a lot and from 2 friends' experiences.

I guess it's just something to think about....

I am so sorry to here this, I know this has to be hard on you. I am exspecting a letter anyday now and now I am in great fear.

Oct 23 2009 - Received letter - approval date 10/19.

Yeah Becca, that's what I was talking about, kinda. The requirement to meet in person is almost never waived because usually the hardship comes from only one side. Sometimes it might be hard to find a way to meet, but it's possible.... that's what I meant on my previous post.

Anyway, I don't have the intention to turn this thread into a lesson or anything like that. All I want is to remind people of what I've said before and of what Becca said.... that requirement is rarely waived.

OUR COMPLETE TIMELINE

Latest steps:

10/26/2006- Consulate receives case (seriously, one month to receive the case?? BS!), and packet 3 that I sent even before they had received the case.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!

It's just sad that the 'lesson' for members, if any, is at the expense of one of our own.

I-130 petition in DCFR Tokyo: March 14th 2004. Case reffered to DHS USCIS

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

I think a waiver is rarely granted but it is there as a legitimate option for the people who need it. Jabree get everytinng in order, get as much help as needed to build the case as to why you are qualified for the waiver. It may be difficult, but it is not impossible. Good luck! you really should consider going to meet your fiancee. love should take you there to him.

get with the other ladies that are traveling to Egypt to see their SOs and you travel with them

if you are afraid to travel by yourself.

I really don't understand your multiple posts here on this topic. What is it you want? You're told you don't qualify for the waiver, but you won't say why you think you should, and you are just posting mysterious and vague references to what you're doing.. how is your information going to benefit anyone else (purpose of sites like VJ)?
