Hi Annalise,

If you have filed the I-134 and NOT the AOS affidavit, you could possibly look at what you are actually on the hook for.

The I-134 is for the non-immigrant portion of the visa which has less stringent requirements and is desIgned to ensure that you are able to support him for the few months before the marriage.

I don't know this for certain, but it may be that if the marriage does not work. And you did not file for the AOS, that technically that I-134 may expire along with the visa..

This would imply that he would leave as he should of course. Hopefully he cares enough not to jam you up with that situation. But as others have said, you could always just be straight with CIS.

This is not something I have looked I to my self but would be interested to understand how it works.
