I am confused then....it states that we could file for the I-130 and then the K4? I am confused now. :blush:

I will continue to read the information in more depth.......what I have read says that we can apply for the K4 only once the I-130 has process has begun, and the K4 enables my son to be with us while the I-130 is pending.

Does not work that way... Your USC spose could file the I-130 but it would result in a IR visa not a K-4.

The fastest is K-2 if he is to travel within one year of you getting yours

The K-4 is a derivative visa for children of beneficiaries of K-3's. Why are you not looking to the K-2?

I appreciate your help, but can I just make sure we are on the same page?

We are awaiting our NOA2, my child is listed as my dependent but we did not apply for him to come with me (for various reasons). So, once I am out there and we are married we want to apply for my son. Are you saying that even though we did not apply for a k2 visa for him that that is the route we would take?

I appreciate your help, but can I just make sure we are on the same page?

We are awaiting our NOA2, my child is listed as my dependent but we did not apply for him to come with us (for various reasons). So, once I am out there and we are married we want to apply for my son. Are you saying that even though we did not apply for a k2 visa for him that that is the route we would take?

Really!!! Oh, wow. Okay, that changes everything. I thought because we had not applied for my son under the I-129F that we would not be entitled to file for the K2 once I was there.

Really!!! Oh, wow. Okay, that changes everything. I thought because we had not applied for my son under the I-129F that we would not be entitled to file for the K2 once I was there.

I need to correct myself.. the K-2 has a one year issuance window after the K-1... not application window.. slight but important difference.

So, we can basically apply for the K2 to be issued once the K1 is authorized up to one year>

yes, applied for and issued within one year of the k-1 issuance..

as for the medical, unfortunately consulate specific answer... but i would doubt it..

You have really helped me so much. I can at least check the consulate now for their guidelines under medical examinations etc. I have to think about how we are going to do this now. Maybe once the K1 is granted (fingers crossed) we could apply for the K2 immediately and I could wait here with my son, so that I can gather all the information he will need etc? I would just like to be able to support him with the official stuff before I go out there.

Once again, thanks so much. You have pointed me in the right direction and I feel a lot more confident about my research findings now.

Okay, I have been researching and researching, reading and re-reading and re-re-reading. Phew! My brain feels like it's going to explode :bonk:

Would I be correct in assuming that once the consulate receives the notice of Fiance Visa Petition from the NVC they will send instructions for packet 3? Okay, now this is where I am not so sure? At the time we filed for the I-129F we only entered my 16 year old son as my dependent, we did not apply for him to emigrate at that point. So, when I receive packet 3 would I be able to apply/add my son for the K2 visa? Or,because we did not initially put him down as emigrating will we have to wait until my K1 visa is issued before I can apply for his K2? I am trying to work out the time-line.

We had some issues initially with whether my son was going to emigrate at the same time as me, or follow due to his education, but we have all decided since that point that he will emigrate as soon as. Obviously, because we all ready started the process it has complicated things, which has complicated my understanding of the process too.

as long as he was listed on the petition, their is no issue with him making application now or up to one year later.

applications are submitted concurrently with or after yours

When you file your visa application to the US consulate in London you can submit his as well at the same time... However, you CANNOT do this until YOUR petition has been approved by the USCIS.

I think you are confusing the petition process and the visa application process...

Ha, ha, ha, ha....you are dead right! I have been confusing the two. Wohoooooooooooooooooooooooooooooooooooooo!!! I finally understand. Blinkin' heck! You are one patient person and I am a dumb-####. Sorry, ha, ha.

I get it! I have been so worried about my sons part in all of this. So, we will have our interview and everything at the same time, and we will be able to leave at the same time, or he can follow within a year. OMG! So simple. Obviously, this is all dependent on USCIS approving our petition, as you stated.

I made the mistake of just letting my fiance' file at the beginning, filled out what I needed to fill out and I didn't investigate any further than what he told me. I have just re-read the I-129F form and what you said makes perfect sense in terms of the information that was required on that form.
