Hello Vjs, can anyone here explain to me the process of "follow to join" kids under K-2 visa ? I'm still thinking if I have to bring immediately my 2 kids with me or later. My Fiance listed the names of my kids at the approved petition and also at his Affidavit of Support. I'm about to schedule online our interview as well as go for medical exam ahead the interview date. I will be paying our Visa Fees ($ 1,050) next week for the 3 of us before scheduling online. But then I still have 2nd thought if I should bring my 2 kids immediately with me or they will follow to join. I know this provision under K-1, however, I'm not so sure how this process will go through. Hopefully, I could get answer/s from all good VJs here. Here are my questions:

If my kids will follow to join,

1. Do I have to pay for their visa fees already together with mine?

2. If no, when are they going to pay their visa fees ?

3. If yes, will I have to already bring them with me during my interview at US Embassy?

4. Just in case, I left them for a while, can I go back to the Philippines within 6 months so I could bring them with me? Am I allowed to travel back here, just in case my AOS is not complete yet?

These are the things that make me confuse. My Fiance has a little knowledge also about these stuff. And I'm sure no one of his family members will help us get through as he lives alone and away from his family. I would love hearing some good advices and experiences.

No.

When they apply for their visas.

They don't have to go to the embassy until they have their own visa interview.

4. Just in case, I left them for a while, can I go back to the Philippines within 6 months so I could bring them with me? Am I allowed to travel back here, just in case my AOS is not complete yet?

You have to get married first, and then apply for AOS, advance parole, and employment authorization. The advance parole and employment authorization are issued at the same time and on the same card, usually within a couple of months after you send the application. You can use that card to reenter the US with your passport. If you are scheduled for an AOS interview then you must return in time for the interview.

These are the things that make me confuse. My Fiance has a little knowledge also about these stuff. He wants already to bring the kids with me, but, I'm just quite not sure because I know I still have to adjust on the new place and I think it would be good if I would adjust myself first, being the mom and make sure apply for AOS, get familiar with the places and culture, find job and able to get driver's license so I can drive before I finally bring my kids.

Btw, I also hope to hear from members who moved to the US with kids, can you tell me your experiences ? My Fiance love my kids very much, but, I know he works everyday and he might not have so much time get us around. And I'm sure no one of his family members will help us get through as he lives alone and away from his family. I would love hearing some good advices and experiences.

a couple of things to consider. the process will be simplier and less expensive if your children come with you , than follow to join. as far as costs go, no need to fly back to the Philippines for your children and AOS will be less expensive if they apply with you. as far as adjusting to a new life in the USA, children probably have an easier time adjusting than do adults. your adjustment will probably be easier having your children with you, than if they are in the Philippines. the time lost being apart from your children is something that cannot be replaced. IMHO, the sooner all of you are united as a family, the better.

When did EAD and AP get merged onto one card?

In February of this year.

Hi "sunandmoon", I think you are God sent to me. Thank you for sharing your insights. I like your thoughts and ideas - very helpful and inspiring. Honestly, as a loving Mom, I really want to bring my kids already with me so I would have peace, not so much worrying without them. In fact, we already prepared for all the necessary expenses for all of us. Just that sometimes I get confused if I need to bring them immediately with me. I agree to what you share and I think this is what I need to reconfirm my earlier thought / decision. My Fiance hopes that we all come together and live as one happy family. This is great ! Aside from being away from my kids..i adjusted here well and got a good job first ,,being able to stand on my own feet(drive back and forth to work)

It is hard to be away from ur kids but everything was planned and it all worked out good in God's time and my kids are finally here with us.

Hello "happyblessedme", thank you so much for sharing. I'm glad that your kids are now with you. God is good ! Yes, in time everything will be fine especially knowing that God is behind on us. I thought of leaving my kids for a while, but, I'm also bothered with their situation while I'm away. I don't have close family members whom I can trust taking care of my kids welfare. I'm worried I may be thinking of them most of the times. With this, I'm now decided that I will take them with me immediately. Thank you again and God bless you more.

Happyblessedme, I am so glad that you answered this post. I have a post elsewhere that has asked similar questions as I am too going out on the K-1 Visa and once married applying for my 16 year old son to come out too.

Me and my fiance' are currently awaiting our NOA2 (3months so far) , so hopefully we won't have too long to wait.

Please may I ask you some questions?

Do you have to wait until you have AOS before you can apply for children?

I read that the child can all ready be in the country (USA) while you apply for them this way?

Will my child need examination in his home country (U.K) etc and will I need to return home to be with him for this?

Do you know how long it may take to apply for kids separately?

Is applying for kids separately a similar process to K-1? Medicals, police report etc etc.

Me and my fiance' have briefly discussed this and we figured that we would fly my son out a few months after the process has begun. I am not sure if this is possible.

I am soooooo glad I have been watching this thread. I am worried about not knowing how things work. I really want to be able to discuss this all with my son.

Any information would be really great.

Okay, I have been doing some research and so far I have found out that we would file the I-130 -- Petition for Alien Relative, and my son could join us out in America under the K4 visa while the I-130 is pending. My son is 16, so he is classed as a dependent.

still need to do more research... your child would NOT be able to follow on a K-4, unless you arrived on a K-3 (same as a K-2 needs the parent to be on a K-1).

Will my child need examination in his home country (U.K) etc and will I need to return home to be with him for this? Examination is required by the doctor/clinic authorized by the consulate that will issue the visa

Do you know how long it may take to apply for kids separately? Typically not very long but depends on the consulate

Is applying for kids separately a similar process to K-1? Medicals, police report etc etc. Same visa application, fees and medical are required
