Is my relationship to new to apply for K1?

Hmmmmm, I don't wish to discourage you or alarm you, but I read that you have to have proof that you have had a relationship of at least two years, and with at least one face-to-face meeting. Me and my fiance' have just started the K-1 process and I can clearly remember reading that somewhere.

Received Visa's (K1 and K2) February 23rd 2012.

I stand corrected; you have to have met 'within' 2 years. You can read it in the pdf I have attached for you.

You do not need to have proof of a relationship that is 2 years long. You need to have seen eachother in person in the last two years. You could meet on the train today and file tomorrow.

Hi,

My first post on this great site. Allot of useful information I have been reading for week.

Myself and my girlfriend have only been together for 3 months. But we know exactly what we want to do. Will the US government get this, will they have an issue with our relationship being so new? If so what would you say is the minimum amount of time to be together before applying purely based on the application process?

I am from the UK. British. She is from the US. American. No convictions. I have a good job, no debt.

Also if we did apply and it was to soon would it prevent me from applying again in the near future?

The only condition for filing a petition for a fiance(e) visa is that the petitioner and the beneficiary have met, in person, within the last two years of filing the petition. There is no minimum dating requirement, just a meeting in person requirement for the initial petition. Since you are from a "low fraud" country I doubt that this would become an issue by the time your interview were to take place. Additionally, by the time you have an interview at the American consulate in London, your relationship will be months long and you will have had more time to gather evidence that would prove the bona fide nature of your relationship.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

She will petition for you first. After that is approved, you will be able to apply at your local consulate for the visa. At that time, she will provide financial documents proving that she can support you at 125% of the poverty level or over. You have been together in person 3 times, have the tickets, passport stamps and photos to prove it. It won't matter that it has only been 3 months before she files the I-129F petition.

regarding being 125% above the poverty level. how can this be proved. she is a student and only works part time.

how long will the period be for and how recent would the period need to be?

Usually, consulate asks for last 3 years of transcript. If she will be unable to qualify on her own, she can get a co-sponsor, to help with this requirement.

Some particular reason the two of you want to live in the US instead of the UK?

You said you have a good job and she's a student. Would it make more sense for the two of you to live in Great Britain?

You aren't applying. She is petitioning for you.

You are required to have met face to face.

No correct amount of time for your relationship. You do have to prove a bona fide relationship. Meaning that you are not doing this simply for immigration to the US. Do some reading in the K1 forum and the UK forum to get a sense of what is typically sufficient to prove the relationship.

My fiance is in the UK, we met and it was love at first sight. We opted to visit a few more times and learn more about one another. Our bond only became stronger. Once you start the process it will take some time. We started in March this year and are almost at the end of it. This gives us that much more time to experience one another. Best wishes!

She needs to be making at least $18,388 a year to bring you here.

Seriously. Make a list of pluses and minuses for living in the US, and another for living in the UK. Take into account earning potential, cost of living, family support, social support and safety nets, and cost of health care.

We did that. I liked in the UK for a month and she lived here for a month. We learned a lot, it was eye opening. We decided on the USA. At the end of the day there will be no discussion if we made the right choice because we researched it. My cousin lives in the UK after being raised in California. He is happier there, good for him. It is a decision you must make for yourself.
