Hello my fellow VJer

I have been lurking this forum for a few months now, and I need your help on my case. I just submitted a CR1 I-130 package to USCIS and got accepted on August,22 2011.

I broke up the relationship with my ex-girlfriend in US after 8 years of turbulent relationship on October 2009. My ex-girlfriend have been in jail 2 times for domestic violence, the second time on October 2009 and end up in a Criminal Protective Order against her, which expired on November 2013.

about 8 months after I moved out I met my current wife in VN via www.vietfun.com, which is on June 2010

I went to VN for the first time on November 2010 to meet my wife for a bout 3 weeks, after came back to the states, I proposed the marriage to her on February, 14 2011, and the the wedding took place on July 1011, then we sign the marriage certificate on August 3, 2011

Here my background

have two kids and have full legal and physical custody of the kids

working nonstop since 1999

income close to six figure

both my wife and I married for the first time

40 years old man

my wife is 16 years of age younger than me

wedding have my parents, my two daughters, one brother and one cousin from US

my wife dont have any relatives here in US

Since we know each other we talk to each other twice daily, before I went to bed, before she went to bed, not skipping a day rain or shine

When I sent I-130 package I included

detail timeline with pictures embedded (public notorized)

40 pictures (skype screen captured, first trip, wedding ceremony, honeymoon..)

credit card statement show I bought airlines tickets, hotel expensed...

sample phone call history from fring out, skype logs

Now potential red flags

knowing my wife in short time after broke up with my ex-girlfriend - 8 months

no Dam Hoi

married on second trip

No divorce (since there is no common marriage law in California)

short time from marriage proposal to marry - 5 months

Note:

Just before I went to VN to marry my wife, my ex-girlfriend came to court and claimed that she married to me, and but the court found no evidence that we are legally married and potential dismiss the case (my ex-girlfriend have 30 days to find any ground to support her claim).

So are there any potential red flags I need to address ?

Yeah case looks in solid shape. Quick relationship is probably your weakest point. Since you had a wedding ceremony, I would assume the no dam hoi isn't a big deal. Try to go back and build photo evidence. Its the number one piece of evidence they care about at the interview. Also, the girlfriend situation is better than having been married. Also, try to go to the actual interview and prepare both parties for grilling fun (or not).

K-1 Visa

I-129F application received at USCIS: November 30, 2010

I-129F approved: March 28, 2011

Packet 3 Received: April 11, 2011

Packet 3 forms submitted to Consulate: May 4, 2011

Packet 4 received: June 16th, 2011

Interview date: July 25, 2011 (Pink!)

Pick up Visa: August 1, 2011

POE: August 5th, 2001 (Woot!)

Short meeting and then marriage and no dam hoi is a very big red flag. They will hammer you on the previous relationship. Even though it appears a non legal marriage means nothing really. A long time relationship then all of a sudden you break up and then right away hook up with a VN babe looks suspicious regardless.

Short meeting - We been talking for 5 months before I went to VN to see my wife and I spent 2 weeks with her, alone

Marriage on second trip - I am a engineer leader, and have full custody of my kids so taking long and often vacation is not easy, I discussed this with my wife at the beginning (this have been explained in the timeline)

No Dam Hoi - as of above I dont have much times, and our family and relatives are in US, plus take about 7-8 hours form my birhtplace to my wife hometown, plus no one do Dam Hoi now a day in VN.

Previous relationship - This is no sudden break up. The events dated back to 2005 with

* one Child Protection Services report on 2005

* two Child Protection Services reports on 2006

* one police report for Domestic Violence on 2007

* one Child Protection Services report on 2008

* one police report for Domestic Violence on 2009 ==> result in No Contact Order, then Criminal Protective Order expired on 2013

* I have full legal custody and physical custody of my kids

So technically I can not stay with my ex-girlfriend due to court order.

I plan to go back to VN with my 2 daughters once my wife has interview date. we will go on the interview together (includes the kids).
