Don't use drugs... How simple is that?

Who said anything about "using drugs"?

I am concerned with mis-communications.

They ask my fiancee if she has ever used drugs and she thinks they are talking about pharmacutical drugs like Asprin, so she says, 'yes' and gets a lifetime ban.

Not too funny to me. Funny to you?

They ask my fiancee if she has ever used drugs and she thinks they are talking about pharmacutical drugs like Asprin,

I don't know if this will ease your mind or not, however, when I was in China last February, I had a plastic sack in my luggage that said '{name of company} DRUGS' on it that my wife saw and said to me "drugs?" I simply told her "medicine" and she immediately understood. I suppose the point I'm trying to make is the term "drugs" would be likely be interpreted as the illicit kind and not the pharmaceutical kind.

You're misinterpreting the law. It doesn't say that they will be banned. It says they are inadmissible. The US government doesn't want aliens with a history of certain crimes coming to the US. Most countries have similar laws. Some inadmissibilities can be be waived if it poses a hardship to a US citizen or LPR. Some automatically expire. Some cannot be waived and never expire.

There's a list of most inadmissibilities in INA section 212(a). Waivers are described in section 212(h).

I have been reading alot of posts about people getting banned for a year until they can test clean regularly.

7/15/11 Sent K1 Petition to Lockbox

8/10/11 STILL NO NOA1!

8/12/11 Called USCIS to get receipt number-NOA1 will be resent

8/16/11 Received NOA1 with date of 7/20/11

1/3/12 NOA2!!!

1/12/12 Got email notice we are through the NVC.

Hey Ryan,

Thanks for the reply.

I do appreciate it.

You know how it is, when there is so much at stake, you want to dot every 'i', cross every 't' and prevent every possible problem or misunderstanding before it happens.

Most people get that, a few can't seem to grasp the concept.

Take care,

Hello,

I read a post here that admitting to prior drug use during the medical exam would result in a lifetime ban from being able to enter the U.S., with no waiver or forgiveness considered.

In my opinion that is cruel and heartless beurocratic stupidity.

To keep two people who just want to love each other, apart, because of that, is cruel.

Hollywood stars, rock stars and athletes are treated as if daily drug use is perfectly okay, welcomed and acceptable; illegal aliens sell drugs and are violent...

My question is, what else can result in a lifetime ban that we need to be aware of?

Parking tickets? Spitting on the sidewalk. Refusing to bow to a Government God beaurocrat?

Seriously, anyone have a list?

It doesn't hurt to warn the fiancee of all beaurcratic traps at the interview that could destroy her greatest dream and mine.

notmuch88tosay

Don't know if it is a ban but surely it is not. As far as admitting drug use. I think that is like the Army asking us when we enlisted if we had used Marijunna. I think that was more of an intelligence test. Why in hades would anyone with half a brain admit to something like that.

...but you never know what a woman will say.

:wow::blink:

Anyway....all that aside, if she doesn't do drugs that are illegal, its a non-issue, right? Its normal to worry about things but don't get so paranoid you find extra things to worry about when its not necessary :ot2:

This woman says that statement is very offensive.

Yes, he also somehow thinks that the "drugs" and "medicine" conundrum that occurs in English exists in all languages.

"but you never know what a woman will say." ---Why marry the woman then? Why go through so much K1 visa trouble if a woman is so dumb? I feel so bad for those men who feel that they are better than women. 2. "Using drugs" in all legal papers means using illegal drugs. Otherwise it's medicine. See, even women know that!

First off people are confusing "inadmissible" with "lifetime ban". Admitting drug use doesn't cause a lifetime ban. It makes you inadmissible and requires a waiver be requested and granted. I know several people who have admitted to drug use and after going through the bureaucratic hoops they were finally admitted. To be entirely blunt, I don't care that it seems unfair. Should we allow someone who knowingly willingly uses illegal drugs to immigrate to the US? My opinion is Absolutely not. Immigration is a privilege not a right.

Secondly if you (or whoever) haven't prepared your wife/fiancee adequately for the interview and medical to the point that she doesn't know that they are asking about illegal drugs, not prescribed or over the counter drugs then that is a failure on your part, not the part of the system. I don't know why on earth someone would go through such a crucial process as filing for a fiancee/spousal visa and get all the way to the last step and then not make darn sure that their significant other wasn't as prepared as humanly possible.

i have a friend whose husband admitted during his interview that he had used drugs in the past when he was a teenager (he was in his late 30s at the time of interview). they gave him a 3 year ban and after his 3 year ban they have been requesting more and more information...point is, it's been about 5 years and he has not been given his GC. In my opinion, unless you've been arrested or you have a criminal record of using drugs, DON'T SAY YOU'VE EVER DONE THEM!

Wow. Absolutely never ever ever lie. Admitting to drug use may get you a three year ban but lying just once gets you a lifetime band and that lie will follow you for the rest of your life. Even a lie by omission. It could be years or decades down the road and your LPR status and even your Naturalized citizenship can be revoked. If you don' believe me find the news article about the couple who had been naturalized citizens for 25 years when it was discovered that they omitted the fact that they had gotten married while waiting for the petitions filed by each of their parents were processed.
