Wife wants our baby born in Philippines

My wife is from Bohol and we have already gotten her visa and gotten married. We're still working on her Green Card now. We have recently found out that she is pregnant now and will be due sometime in April. She is thinking of going back home for the birth and then a couple months after I'll be able to join them and us come back home together.

My question is, where do we start for bringing the infant back to the states with us? I'm sure we'll have to have a Philippine Passport, but will we have to go to Manila to the Embassy? Any help is appreciated.

Are you (the dad) a US citizen and have been resident in the USA for at least 5 years? If so, your child will be a US citizen too, even if born abroad. Once b orn, you will need to apply for CRBA (Consular Report of Birth Abroad) at the US embassy in Manila, and the child will get a US passport.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I presume from your post that your wife entered on a K1 visa, married you, and currently adjusting her status.

If you are a US citizen and you meet the 5 years US residency requirement, then your child will be a US citizen. You must file a CRBA and obtain a US passport for your child. US citizens must have a valid US passport as proof of citizenship to enter the US.

If your child is not a US citizen, then the child only needs a Philippines birth certificate only to return to the US with your LPR wife on her first trip back to the US after giving birth. It must be your wife's first trip back to the US after giving birth. The child will be granted LPR status when he/she arrives in the US.
