I-864 and !-864A forms

Hello everyone,

My fiance' got approved for a K1-visa, he is now here in the US and we already got married last week . We are now in the process of filing for Adjustment of status. I am currently a student and not working and I understand that someone needs to co-sponsor, in our case, it will be my mother. We just need to know which form should we file? Should we both fill out the I-864 or should I fill out the I-864 and I-864A for my mom? Please let us know if you have any idea/info on this. Much thanks!

You fill out an I-864, your joint sponsor (your mother in your case) will fill out an I-864.

Incorrect, if the OP's joint sponsor is combining their income with the income of another person, then that other person would complete the I-864A to accompany the joint sponsor's I-864.

Do you live with your mother? If you do you are able to have her complete an i-864A to go with your I-864 in order to combine any income. You don't HAVE to though and can have her complete her own I-864 if you like.

As you have no income the option of completing her own I-864 is best because she would not need to support YOU in her household size but with the I-864A she would have to.

Out of interest, and not to be rude, if you're not working, how exactly are you planning on supporting your fiancee and later your wife? When she arrives on the K1 she can't work for several months while waiting for her AOS to process. AOS costs $1070 to file. She will need a car/transport, food, and other girlie necessities. I understand you want to be together but some people forget about the cost of living when they've been existing in a certain way for a while and then another person comes along and the small amount of money they had that they were able to stretch here and there is no longer stretching causing strain on the relationship.
