Hi,

I have a question about I 864. My husband is an USC and he is filling form I 864. His income is insufficient, so we decide to use our joint savings and checking to file the form. Our accounts were opened in the US a few months ago. Do you think that we will be able to use them although they are very new? If we can use the accounts, what documents should we send to prove them? I also have a saving account oversea. Do you think I can use it? Does it need to be three times or five times the difference between the required income and my husband's income? Also, can I use both our savings and my savings oversea?

We will strongly appreciate your help.

Yes you can use the accounts. You will need bank statements- preferably on official letterheaded paper from the bank. Since they are so new, if there is significant money USCIS may want to know where it comes from, so show proof of that too, for example that you sold your house abroad, that the money was in your account abroad for years etc. Yours US accounts must cover the income short fall x3, the foreign accounts x5, but they may still not accept foreign accounts, it is up to their discretion.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
