I am wondering if anyone has been through my current bad scenario, and how much time it took to correct. I am a USC and I just got a letter from the NVC stating in cryptic language that "the Immigration and Nationality Act does not allow derivative status to family members of immediate relatives." After doing some reading, I now realize that I made a big mistake in not filing a separate I-130 for my stepdaughter. I have a few questions now and am feeling a bit lost at sea here and would appreciate any advise:

1. I submitted photos, birth certificates and the marriage certificate (along with all the other required CR1 packet and AOS packet documents) to the NVC for my wife's CR1 application, not knowing that I had to file a separate I130 for my stepdaughter. Will the process proceed for my wife now and not my stepdaughter?

2. Should I submit an I130 for my stepdaughter ASAP?

3. Will the interview date be set now for my wife and then later for my stepdaughter?

4. Do I need to submit a new AOS and CR1 packets just for my stepdaughter?

Answers to any of these questions would be much appreciated.
