hi i hope someone can help with this question

i want to know if i file for my dad when I turn 21, will he be able to come back here?

my dad was deported when I was 3 or 4 after a brief stay in prison. i'm now 18. he was here legally (his stepmom filed for him when he was 13) but got into some trouble when he was in his late teens/early 20s and was sent back to jamaica after staying in prison for about a year. i don't remember the exact charges but i know it had to do with drugs. since he was only in jail for a year or so i don't think it was a lot of drugs.

i keep in touch with my dad and love my little brother and sister so i want to do what i can to help them have a better life. do you think that he will be able to come back if i file for him in 3 years once i'm old enough to file?

a couple of things:

i know it's 3 years away but i wanted to start with getting everything together now.

his stepmom is willing to help me file and help with cosponsoring him.

He can get an I-601 waiver only if the conviction was for simple possession of less than 30 grams of marijuana. If it was for any other drug then he's inadmissible pretty much forever.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
