Can any one advise on the process for my Fiancee 's child who has a different last name..... does this create a problem and how to solve???

Is the child her natural child? If not, has she legally adopted the child? If the answer is no to both, then an adoption would need to take place before the child has a path to immigrate to the USA. If the answer is yes, to either question, simply include the child's name where asked on the I-129F and later the child will apply for visa, in the same way the mother does.

Its her natural child just she used the fathers name..... so if her name is on the birth certificate its ok?

I was thinking maybe the father need to give consent to moving to the states.....??

If the father's name is on the birth cert, then even if they were not married, he will probably need to give consent (or you need to get a court order allowing the mom to take the child out of the country), but it depends on the country she is from.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

This is where filling out your profile to include country etc. is helpful. For the Philippines, if the parents were never married, the father has no rights, so no need for consent.

I see. My point is that the senior members know the answer AND though the answer is country specific as many others are, posts that need country specific answers are routinely answered in the upper forums. No real need to move such discussions. Not as many senior members available in many of the regional forums. Just my opinion and advice. Up to you.

You will not need anything from the father, see the link in my signature. We are currently in the process of bringing our second child from the Philippines, both have father's acknowledgement on the birth certificate but were born out of wedlock. There is no problem.
