Hello everyone!

I am writing because I am currently on OPT and am looking at options once it ends. The company I work for has told me they are unable to sponsor me because they can't justify why they would be hiring a non-USC for an administrative job (I currently work as an assistant for an agency). Thus, I am looking at my options.

I've been looking into the E-2 visa and have beent thinking hard about it. My family is considering buying an apartment in the state I live in, and to do so, they would form a company (family is all non-USC by the way). The company would be a film & tv production company (a service company). Could the substantial investment be the apartment, since it would act as the office and HQ for the company? I am a writer/director/producer so the company would hire me to handle the investment and see out all the projects. Is this possible? Would we need to hire other people (USC) or could I be the sole employee of the company? Sorry if my questions are vague, I'm educating myself as much as I can before seeing an immigration lawyer.

You can try but its not going to work.... just starting a brand new company with purpose for you to stay in US and just buying an apartment would not work.

It would still be a fully-functioning company. I'm just wondering as to what the details of the actual company need to entail per requirements.

Allow me to rephrase. My intention is to stay on the grounds of working as a director and writer. I already have projects in development/pre-production. So I would not be creating this company for the sake of staying in the country, but I would actually be following through with its initative and purpose. It would be a small start up at the beginning.

I do not think that the E2 has a path to a green card if that is something that you are considering.

Not specifically interested in pursuing a green card. Just the E-2. I can renew the E-2 before it expires. Would the apartment count as the investment, or would it need to be other elements?

Just apartment would not, you would have to show a fully functional enterprise. Check out the wiki link included in earlier post how they calculate the investment and from busines to business it could vary.
