REFILED a new I-130 and I-485 petition with a lawyer. please help

Timeline

If you are in Louisiana your local USCIS office is most likely Dallas and they are pretty quick when it comes to biometrics and all. But that comes later. It doesn't matter where you live as the application is sent to either CSC or VSC.

Excusing the lack of any documentation is not a problem of where you live, it just shows how incompetent your lawyer is.

If she sent the application properly, she should at least be a tracking number to show if USCIS recieved the application. Then your check should be cashed and you should recieve at least that number from your lawyer.

I think you need to be a little more aggressive with her.

Your lawyer is taking you for a ride, plain and simple. Find a new lawyer, or lose more time and money with someone who probably won't be able to help you when the going gets tough. Your lawyer does not appear to even be able to file simple documents or understand the timeline or process for them, how is she going to be of assistance when USCIS wants to look into your prior marriage or anything like that? Not all lawyers are good lawyers.

10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved

Thanks Harpa! Now I'm really thinking she did not send it. If some lawyers can do it like the one on that thread. She can do it too! She said USCIS received it and that she has the confirmation. I'm so desperate to ask for the tracking number but I don't want her to think that I do not trust her on this. I'm afraid she can make my life miserable since she has all our documents.

On my previous application the one that has been denied, I filed it myself and everything went fast! really fast! If it is only like that easy I should have filed our current application my self. But since my situation is a little complicated, We hired a lawyer. And this is what I'm getting.

I would go down to the office and demand the tracking number and proof that she sent it. That is your tracking number, not hers. If she can't provide it, I would fire her anyway and go it alone for the time being. Your case may need a lawyer but in this situation no lawyer is better than a bad lawyer. If she truly did not send your packet in at all despite the fact that you paid her, I would demand your money back and report her to the Bar as needed. Good luck!
