i-864 mixed income W-2 and 1099. Employed? Self-employed?

Should I file i-864 as self-employed?

Here's the deal:

I work on temporary projects (film productions), which hire me as an employee for around 3 months. This generates W-2 income. I also work freelance, also on film projects, generating 1099 income. I file a Schedule C, but my income is mixed from W-2s and 1099.

For box 22 on the i-864, I think I should put self-employed, because I am not specifically employed by a production company currently.

Also, for the letter of self-employment, should I keep it simple and simply say that I am self-employed?

Does anyone know if this can trigger the Feds to go looking for self-employment tax for previous years?

I plan to file 3 years worth of tax transcripts, all over the 125% poverty minimum for my household of 3.

PS - This is my first post... so just want to say thanks to VJ for the forum... I've learned a lot here to bring my French wife to the US.

For a self employed person the income used in the I-864 affidavit of support is line 22 of your most recent (2010) 1040 tax return. Does this number exceed $23,162?

@Anh map

Yes, line 22 on form 1040 for 2010 is over $35,000, well above $23,162.

Given that, I am planning to check box b. Self-Employed for Item 22 on i-864, and write a letter of employment for myself following the template I found somewhere here on VJ.

I guess you would concur?
