My fiancee in the Philippines has a child who's last name is not the same as my fiancee's. Her daughter's certified birth certificate has the child's last name listed as her father's, and her father is also listed on the BC. My fiancee has a CENOMAR but does not possess a Solo Parent ID. I don't believe this will be an issue in obtaining their Visas, but will there be a problem with her daughter leaving the Philippines? The Philippines Bureau of Immigration states "In cases of illegitimate children, if they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD."

Does this still apply if the child does not have her mother's last name? The site also states "Since the mother has the absolute parental authority over her illegitimate children...."

i traveled multiple times to UAE bringing my sisters' boys to UAE without any issues (2 sisters, boys different last names. i was the legal guardian).. we used DSWD cards to secure clearance and were allowed to travel by the immigration

:ot2: im prety sure it wont be an issue if mother and kid does not have the same last name... so long as she has ID on her name as the mom on the birthcert.

everytime we travel, we made sure i had an orig copy of the kids' birthcert, photocopies and ids other than my pp. i'm sure it wont be an issue

POE = Feb.18, 2012

SSN Received = Feb 25, 2012

GC received = April 5, 2012 (incorrect data entry :((, sent back April 9, 2012)

CORRECT GC RECEIVED = August 22, 2012, granted IR1 (10 year gc)

that's where our USCIS process ends for now.. will wait for the next 3-4 years what we'll do next...

I have a sister in Japan who has the same issues, she is not married to the father of her child and the child has the father's name. On the child's first trip to the Philippines, we were worried about the DSWD thing... she had the birth certificate translated from niponggo to english in case they will ask about the different last names, but nobody ask her those, they went through the airports pretty fast and now has been travelling back and forth twice a year with no problem. I do not think it is an issue.

Per Philippine Family Code, since the child was born out of wedlock the mother has SOLE PARENTAL AUTHORITY.

My kids has their father's last name different from mine since we were not married.

Yes DSWD clearance is needed if the child is travelling other than the parent.

I went home last year to bring my kids over here and had no issues about them being illigitimate.

That's what I figured, but just wanted to be absolutely sure. At this stage really unsure of how strongly/loosely laws are enforced in the Philippines. Kind of a ####### shoot. Thanks.
