Hi im petitioning for my step daughter.....her interview in kingston Jamaica is in september. do i need to get a letter from her biological father giving permission for her to immigrate to the USA... anyone who recently had this type of interview plz reply .... thank you

Better to be safe than sorry and yes, get the letter - have it signed in front of a JP - Also, you need to prepare yourself for the possibility that the embassy will request a DNA test - unfortunately, it's not something you can know till the actual interview - but often, especially if the parents weren't married or the father was added to the BC later on, they will request it.

My wife and step-son (age 5) recently returned to the US with me as CR1/CR2. In my wife's divorce she was granted full custody of my step-son. No quit claim or acknowledgement document was needed from the biofather at any stage in the process. At the consular interview, the CO asked about the divorce and what if any visitation had been taking place and if the biofather had been told about the immigration. The CO said explicitly regarding even telling the biofather about immigrating to the US "you are not required to do so"

Unless the laws of Jamaica are different.............or there is shared custody, I think that there is no need for anything on the part of the biofather for immigration. There certainly was nothing needed in our case.
