Timeline

my fiancé is in the uk with an expired visa (has been expired for over a year). Will this affect our k1 application?

we initially wanted to have him go to the us embassy back home in nigeria but for some reason his application was sent to the office in london and we are worried!!!! his interview is in two weeks

Is this an expired US visa or UK visa? Does your fiance live in UK or Nigeria. To answer your question, you are going to hav eto provide a lot more details as to what your fiancee's immigration status is.

my fiancé is a nigerian citizen living in the UK. His UK has expired. Hope this helps

When we filed the k1 application we stated that he was living in London and wanted his interview to be done in Nigeria, but they still sent it to the us embassy in London.

Timeline

Personally CO could make out he is living in another coutry with disregards to laws of that country and if allowed this person to enter US he would have no regards for US laws either.

To me it would show that this person is not of good character and CO could give him hard time and worst case not grant K1.

Normally, a beneficiary needs to be legally in the country he is interviewing in. That would mean your fiance cannot interview in the UK. NVC may not have realised his UK visa is expired.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It was a mistake using the uk address while you knew he had being residing illegally there.I am hoping during his interview he wont be questioned on his status there.

You can only pray and hope it doesnt get to be mentioned.what was the initial visa duration he had..did he ever renew it.

It appears you are not legal, need to fix immediately. US will not look kindly on this.

Welcome to VJ,

You guys are taking a huge gamble and may end up shooting yourselves in the foot. All the embassy has to do is ask for proof of legal immigration status in UK and the K1 expedition would have been torpedoed. Your man has to depart the UK immediately while the petitioner files form I-824, Application for action on an approved Petition with USCIS to request that they notify the US embassy in Nigeria of the petition approval for Visa processing purposes. This i believe may be your safest route. DO NOT RISK GOING FOR THE INTERVIEW Maybe other more experienced Vj members can assist further. Good luck

He had his visa in London renewed twice before it finally expired. I think the safest route is to find out how his application can be sent to the us embassy in Nigeria

I think it will be best option for him to move down to Nigeria..You can mail the embassy on the need to have to interview done in Nigeria.Just telling them the need for him to be in Nigeria as his visa is due rather than him being questioned at that point

all you do is email / call the US embassy in the UK and request the case be moved to the correct embassy in Nigeria because he is going back to Nigeria. Then you contact the US embassy in Nigeria and let them know you are having his case transferred from the UK to them.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Based on that, i would think that the US embassy will not look at your case favorately. Be ready to explain the reason why he is out of status in the UK. I can tell you that when we petitioned and applied for my wife's (then fiance) K-1 visa, my fiance had overstayed in another country before. The CO asked why, she explained why and the Co was satisfied with her answer and she issue dher visa. I am not saying that is going to happen in your case, I am simple sharing our experience. I hope it helps

This was the case with me and my fiance about 3 years ago. He over stayed in London for only 5 months and when he went for his interview they arrested him and sent him back to Nigeria. So your fiance should be careful that it doesn't happen to him. Me an my fiance never got married cos we lost contact with each other, but now we are good friends and we both have married other people. I hear from him about once a year and I looked for him the last time I visited Nigeria but could not find him. So please warn your fiance this could happen to him.
