Hello everybody does anyone know if I have a religious ceremony in the Ukraine would this make me file for CR1 instead of K1?

Thanks in advance

M.

This all depends on how you go about it Ukraine. A simple ceremony for the sake of having a ceremony family can attend isn't a legal marriage in the eyes of the Ukrainian government or the US government unless you have gone through the rigorous paperwork process in Ukraine to make the marriage legal. If you have gone through all the documentation then the marriage is recognized and you would file a CR1. Otherwise a K1. If that makes sense. I entertained the idea of a ceremony in Ukraine also but was unable to meet the time requirements needed for the processing of the paperwork (30 days or so unless you have a letter from your employer on a company letterhead stating you are allocated only so much time for vacation to expedite the process).

Even a "non-legal marriage" can cause a K-1 to be denied. http://www.visajourney.com/forums/topic/266708-denied-k-1-visa/

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Generally, a wedding ceremony of any type when filing for the K1 is not recommended. It can create confusion as to whether you are legally married or not. This could delay or derail the K-1. The US Embassy may come to the conclusion that you are married and deny the K-1. This would force you to start all over with the CR-1.

Either make it a legal marriage and file for the CR-1 or don't have the religious ceremony and file for the K-1. Trying to have it both ways - religious wedding ceremony and a K-1 visa process - could create delays in getting your fiancee/spouse to the US.
