I have my interview for I-485 on september 7, 2011, so I am gathering all the documents I will need for that. In one of the points it says "all travel documents used to enter the United States including passports, AP, and I-94's (Arrival Departure document).

I only have a copy for the I-94, but I have the stamps in my passport showing the dates I entered to U.S.A.

Should I ask a copy of the original I-94? (2007) or is enough with the stamps and the photocopy? In the package of documents I sent the copy of the I-94, but I don't know if in the interview they will ask me for the original. In the case that I have to request a copy, how long time it takes and how much is the application?

Thank you for your help

Yes, you will need the original. Not having it can result in anything from a lecture all the way to an RFE for you to submit it. The Adjudicator's Field Manual states that the IO notates the I-94 that the applicant adjusted and sends it to the standard CBP data entry center for processing. The original document has magnetic ink that allows it to be read through a machine.

You will not have enough time to apply for a new one before your interview. If you need to get a new one, you need to submit an I-102 with the current fee of $330. The processing times in most places seem to hover around 2.5 months.

It's up to the IO on how he/she wants to handle it. You could just end up with a lecture--or they may make you get a new one.

Good luck and please let us know how it goes.

My mother filed a petition for me in 2007 and my brother sent the I-130 and I think he sent my original I-94, that is why I have a copy because he took a copy of all the documents sent.

If that's the case, you can submit a G-884 to request your I-94 back if it in fact was sent. The filing of this form is free; I would at least send this out so you can say that you did.

I had my interview today and the IO asked for the original I-94 and kept it.

Well, the end of this story is when we went to the interview, the official asked me for my passports (I have one current and one expired with the VISA expired) and the I-94. I said to him that I only had a copy but not the original, he said is OK we have enough evidence that you were inspected when you came to USA. Thanks God no problem.

good to read! I would certainly have hoped it wouldn't be an issue as K1's are given I-94's, only send in copies with their application and are occasionally (like me) approved without interview so there is DEFINITELY no "need" for them to have it or send it anywhere :)

Congrats on your approval!
