Im so sorry to hear things not working out for you, but have u really tried to work things out?? If you really are in love why give up on yr marriage only after 2 years.

It may not be the case, but it does give the impression you married for a green card.

Im am shocked to find forum groups like this, You spend all the time and money getting here to be married and spend yr life with the one you love and then just give up.

I hope this document would be helpful!

What you are offering is information on filing I-751 after divorce and pending divorce decision.

The OP specifically said that he has sent in his I-751, is just waiting for an approval and while doing so, he/she and the spouse are planning to divorce.

I'm sorry Diazy, I browsed through my comment AFTER clicking on the ADD REPLY button. I've been looking for ways to edit it because it sounded like an attack, but I couldn't edit it. :( Anyway, here's my edited version. Lol.

Thanks for sharing the info. I'd like to clarify on this.

What you are offering is information on filing I-751 after divorce and pending divorce decision. The OP specifically said that he has sent in his I-751, is just waiting for an approval and while doing so, he/she and the spouse are planning to divorce. Is it the same banana as to incorrectly filing for ROC with waiver prior to divorce decision? From what I understood from your information is that immigrants are not to file for ROC with waiver to file jointly prior to divorce decision. If he/she does, RFE will be given and must be fulfilled within 87 days. The immigrant should then include the final divorce papers before a decision for his/her ROC can be made.

Let's say they file for a divorce a week after he sent in his I-751, should he go ahead and proceed with the biometrics etc, or is he supposed to inform USCIS about the application for divorce? I realize that the smarter move is to shut up and pray that USCIS doesn't see this and wait for the permanent GC. However, ethically and legally speaking, shouldn't the 2yr GC holder inform USCIS about it? And if he does, does that mean the I-751 which was filed BEFORE application for divorce will get automatically denied? or will USCIS give you an RFE to be fulfilled within 87days and this RFE should include proof of divorce decision? What if you have not received a decision in 87 days? Can the 87 days be extended?
