my wife was given a waiver appointment. she was told that she was guilty of smuggling our kids section 212 a 6e.

she was given the chance to solicit the waiver I 601. our kids got the cr2 green cards and are now living with me in usa and are already in school!

my question is, do i need to show hardship on my end or just the need for family unity?

For the waiver, gather as much information as you can. One key aspect is to show the hardship that you are experiencing without having her here. And also a case for why you can't live in Mexico. Its a good idea to have a lawyer or someo immigration specialist help you with the waiver to make sure you have a strong case. Good luck! God bless

read the research links in the I601 forum. You have to prove extreme hardship to you the US Citizen and why you cannot live in her country.

Definitely get a good lawyer that specializes in these types of things.. and read up extensively about it so both of you can collaborate.

Luckily, making a case for why you cannot live in Mexico is not terribly difficult right now considering the present circumstances. Just be sure that those both scenarios are adequately addressed.

Reading the AAO decisions on the USCIS website can also help extensively in seeing the standards for adjudication.
