Hello,

I wanted to know if any one had insight on the I-765 process for employemnt authorization. My husband and I just got married and filed for a CR1.

I currently travel back and forth to the US on a toursit visa. Would I be able to apply for the I-765 so that can can work temporarly until the I-130 us approved?

I am not even sure if this makes sense but I thought I would ask.

Hello,

I wanted to know if any one had insight on the I-765 process for employemnt authorization. My husband and I just got married and filed for a CR1.

I currently travel back and forth to the US on a toursit visa. Would I be able to apply for the I-765 so that can can work temporarly until the I-130 us approved?

Are you going for adjustment of status? If you are filing for I-485 (adjustment of status) you can file I-765 (employment authorization).. please note that you will have problems, if not already, traveling back and forth on the tourist visa since you have now created an intention to stay in the US.. by filing the I-130. Once you file I-485 you cannot leave the country without Advance Parole which if not obtained will cancel your I-485 completely (regardless if you have a tourist visa or not)

Thanks for the reply. I am not going for the AOS. Yes I have considered the travel back and forth on the tourist visa will raise flags. But there is not much I can do but keep the travel to a minimum as well as ensure my time does not expire.

Thanks for the reply. I am not going for the AOS. Yes I have considered the travel back and forth on the tourist visa will raise flags. But there is not much I can do but keep the travel to a minimum as well as ensure my time does not expire.

I-765 is not part of CR-1, you will get a green card on entry to USA using your CR-1 and you do not use employment card. You only use the green card that you get on entry.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

The answer is - of course no. Tourist visa does not allow to work and the filing for I-130 is totally irrelevant here (theoretically it always can be denied - right ?).

Hey . . . it doesn't hurt to ask, ever, unless you ask a guy with a gun at midnight in Central Park in New York City if he dares to take you on.

In your case, you'll be unable to work until the CR-1 has been issued. Once that's the case you activate it by traveling to the U.S. again and upon entry they will stamp your pass with an I-551 stamp which happens to be the secret code for the Green Card. From that day on you can work and play, and get a driver's license and SSN.
