K-3 and I-130 isn't the same...

OP - The K-3 is basically not available any more. Please follow the guides for a CR-1 visa, the process is initiated by filing a I-130 petition, and NOT the I-129F as well. Filing the I-129F will just delay the process now. There is a guide at the top of the screen.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

what I mean, you can petition your wife using 1-130 and not k-3 anymore, or best the CR-1 visa, good luck.

Your only option is the CR-1. The K-3 is administratively closed.

FYI, be careful whose advice you follow, there are some on VJ that think they know what they're doing but really they don't. LasVegasUSA's advice was incorrect. As Harpa pointed out, K3- and CR-1 aren't the same.

Good luck with the filing.

You should be careful with your phrasing so people will know what you mean. ;)

See bold. And so should you. While I agree that the K3 is essentially not currently available, the statement "The K-3 is administratively closed." is both inaccurate and misleading. Congress didn't repeal the Life Act, so the K3 visa still exists. New administrative procedures at USCIS and NVC, in current combination, have resulted in consistent "administrative closure" of the approved petitions needed to pursue K3 visas but those procedures tend to change over time. If USCIS or NVC change procedure again (There's evidence USCIS may be doing so.) then the combination of procedures may well make the K3 available again soon or already. It's simply not clear.

Best course of action unless there are special circumstances is to simply pursue the CR1 or IR1 visa.
