I have a friend who has won the Visa lottery.He has been in the US for two years since winning the lottery, he has his green card and everything.He is currently married and his wife is in Ghana.can he file for her to join him or does he have to wait till he is a citizen?

So, what is is legal status here in the US?

He is a permanent resident green card holder.He has been in the US for about two years since he got the green card two years ago.I am not sure what other details will be needed.

Thank you very much.I dont think this will work for him.It seems it is geared more for citizens, not permanent residents.IF he files this he has to file an I-130 na dwait ion line behind US citizens who have filed.This will take several years.He is better of waiting to become a citizen before filing.

You didn't read the instruction clearly, but yes as a LPR,his wife will have to wait several years for a visa to be available. It's better to file the petition now, at least it will be approve, once he becomes a USC, then he can request to be moved up in que.

I have read and understand the form but it still doesnt tell me how long it will take for the visa to be approved.From the looks of things there is no point in filing right now if he cant bring her over until he becomes a citizen.

It helps in that the petition will already be processed and the spouse will be waiting for the priority date. Once the GC holder becomes a citizen he requests that his petition be upgraded. So it will save some time once he achieves citizenship.

Once he naturalizes he contacts USCIS and they upgrade his wife's case to that of Immediate relative of US Citizen. No more wait.
