waiting for NOIR (notice of intent to revoke)

Timeline

I received a letter from the USCIS that they received our I-130 petition, that was sent back for review and possible revocation and that I should wait 120 days for them to finish the review.. It has not been 120 days yet but I wanted to no if anybody else experienced their petition being sent back for review. And if so how long did it take for them to contact you?, and what was the result?Ours was sent back cos when my husband went for the interview he was nervous cos his English is not very good, so he didn't answer the questions correctly. Please help! How long will I really have to wait?

You may hear from them from about 60 days until about 6 months. Are you really a K3 or was the interview for a CR1 ?

Mar 28, 2011 Received txt/email saying card production has been ordered. (1month 3eeks 3days)

Mar 28, 2011 Received 2nd txt/email saying we have registered this customer permanent residence status

Mar 29, 2011 Received 3rd txt/email says card production has been ordered.

April 1, 2011 greencard and welcome letter in hand!!

April 5, 2011 received txt/email EAD card production ordered

It was k-3 and the petition was I1-30 for my husband. We have not been married long enough to file for CR1. I think you have to be married for 2 years before you can do that.

If you only filed the I 130 and no I129f you were following the CR1 path * couples married less than 2 years The IR1 is for couples married for more than 2 years and uses the same form. I would be rare to see a K3 processed. So what questions did he get wrong and how many did he get right ? What proof did you send and what more would you have today to prove they are wrong ?

This will not be over quickly. You will not enjoy this.

I guess now they need proof of our correspondence..such as phone cards and proof of my visits there...like passport visas and photos of my visits there with his family. etc. Anyway I am still waiting on that notice. It will tell me what they need as proof.

Lagos is big on proof of communication. They wanted to know all about our, they asked why was my morning call M-F so short, and it was because I called as I walked from the transit stop to the building.

This will not be over quickly. You will not enjoy this.

My application was also sent back for review, but it was a bit different than yours. It was for a K1 visa, and it was sent back due to a question being left blank on the I-129F. It was sent back on 22Apr11. I finally recieved the notice and the RFE on 13Aug11. It was almost four months of waiting with no word about the application from the VSC. The other poster said it best. It can take a long time for them to open your application that was sent back. It has been my experience that once your application is sent back, you go into waiting mode big time. I wish you the best of luck.

If they are requesting more proof, then give them all you got girl. :thumbs: go there with a box of proof to bring your man home if need be.
