Hi folks.

I am doing a little pre-emptive work and getting my I-864 form together to bring my husband here. I don't make enough income (I am just a hair under the line) so, my stepmother and father have agreed to co-sponsor.

My questions are:

1) Do both myself and my stepmother fillout the form I-864 form?

2) What is an I-864A form? Does she fill that out as well? Under what circumstances do we fill that form out?

3) My father is on disability from the government so, he files with her but she is the primary income. Does he have to fill out an additional form(s) since he is on the tax return too or does he just stay under the same form as my stepmother.

I appreciate your collective wisdom.

Consulate calls Faisal and reschedules interview because of holiday closure: 10/27/11
New Interview Date: 11/22/11
Interview Status: APPROVED
Arrival in US: 12/21/11
POE: Miami
ARRIVED!!!!!!! Welcome home!!!!!
Received Green Card: 1/25/12
Received SS Card: 2/1/12
Faisal's first job: 2/15/12
Faisal's first day of school: 8/26/2012
Pregnant: 9/6/2012

It's a Girl!: 6/2/2013

Sent out Removal of conditions paperwork: 9/22/13

Yes, you will need to fill out an I-864 as the primary sponsor no matter what.

An I-864A is used when you live in the same household, and it allows for household members to combine their income with yours to meet the 125% mark.

If your stepmother has enough income on her own to meet the 125% level for herself, your father, any other dependents they might have, plus your husband, then she can fill out the I-864 using only her income. If your father's income is also needed to meet the 125%, then she would fill out the I-864, and your father would fill out the I-864A to add his income with hers.

Okay, thank you. I was under the assumption that my father as a person who was secondary on her tax return would have to file an I-864A to demonstrate that he understood that she was co-sponsoring something that essentially had his name on it too. Is that true? Is it better to be safe than sorry and just have him fill it out too? What do you all think?

That 864A has been requested by some CO's. It can't hurt to have your dad complete an 864A as well. I was thinking that perhaps dad wasn't on board with being a joint sponsor.
