i am about to apply for a police certificate and i believe it will come back showing 'no live trace' due to driving without insurance almost 15 years ago. obviously i will declare this but what im wanting to know is...

1) will this cause any problems as far as getting my K-1 visa is concerned??

2) do i need to submit the court report for the offence and if so how do i get hold of one??

Your Record

If you have a clear record you should expect the report to say no more than 'No Trace'.

No Live Trace - this means that you have a spent conviction. It is recommended that you get a subject access from here before interview. Court and prison records may be required.

Convictions - court and prison records will be required, as applicable.

The subject access report comes from ACPO and I think information can be found on their website. Those take much longer to get.

The subject access report comes from ACPO and I think information can be found on their website. Those take much longer to get.

ok thanks i will look in to the subject access... i have plenty of time yet lol.

can offences cause problems in getting a visa do you know?? it was just no insurance and i went to court, got points and like a £50 fine

I have no experience with offenses nor am I British, so not great help. I think the thing that can affect your visa is a CIMT-Crimes Involving Moral Turpitude. Fraud falls in that category. A recent UK member named advocator had switched tax disks on his two cars almost 20 years ago. They thought they would have to file a waiver. The officer said it was indeed fraud and thus a CIMT, but he approved the visa since it was one time, minor, and long ago. I don't think yours will affect the visa. But if it went to court, then you have to get copies of the court records to show the embassy officer. Otherwise they send people away to get documents and leave the visa pending receipt of the records. I'm not up on that kind of UK court system stuff or the terminology, but the embassy discusses it on their page of what to bring to the interview.

ok thanks thats excellent. i followed the link and i think i know what to do now... i will apply for a subject access straight away and then a police certificate in a few weeks time and see what they both say. if my police certificate shows 'no live trace' i will then take my subject access to the magistrates court and get a Memorandum of Conviction which is what we call court records. then i will take the Memorandum of Conviction and the subject access (to show there are no other offences) to interview... simple lol :)

The police certificate took a few weeks. I also requested a subject access after I received the certificate and it came within a week (don't know if it was because I recently requested the certificate). I got a subject access a few years ago and that took about 5 or 6 weeks.

Either way I had no trace on the certificate and nothing on the subject access - I was a bit unsure of something so I wanted to be definitive!

if you mean the ACPO certificate then that and the subject access are two different things i think. there is a difference in cost anyway lol. the ACPO certificate will just tell you if there any spent/unspent convictions on file or not (it wont tell you what they are) and the subject access request will actually give details on those convictions. the ACPO certificate is whats needed by the embassy for the UK though :)
