Hello to all...please forgive me if I have posted this in the wrong forum...but I have a few questions so here goes!!!

My fiance previously lived in america and was over here thru marriage...he is bulgarian...he was deported in 2005 because of 2 misdemeanors(honestly)...my questions are as follows...

1. Will he be denied the first time around

? I know i will have to file a waiver for him...

2. Is it a very hard process to get him back here...we have been together 3 years got loads of proof and im going to bulgaria in 9 days so we can get married..

3. Is it better to have a lawyer thru the whole process?

Thanks to all...Im just trying to find out a bit of info.....

Not Sure dobromirsgirl. I am in the same boat and going through the processes. My husband now, was deported before we were officially married. We had a baby together and were with each other for a good 2 years before he was taken. My husband didn't have any police record, just in the wrong place at the wrong time. When through a road block without a license and off he when to Mexico. It sucked, just days before our daughters 1st birthday. I went to Mexico for 6 months to get the paperwork down there so I could come back here to make him legal. It has been a rough ride but we just take it day by day. My only suggestion is to keep everything you can to prove your relationship. I haven't gotten anything approved yet but I am still praying that something will go our way soon. Just to the RFE letter today and all they needed was some recent passport photos of us. YIPEE! I was afraid it would be something more difficult to get.

You're not at the consulate level yet. The USCIS will approve your petition but once he interviews at the consulate he will be denied for the visa and told to file for waivers - actually, you have to file them as you have to prove hardship to you, USC. Depending on what's he charged with, he may need an I-601 and an I-212 waiver. You may want to contact Laurel Scott on Wednesdays when she has a free chat about your case - waivers are usually not something to be done on your own.
