If a foreign national (to US) marries outside US and either changes the last name or does not change the last name. In either case is the B1/B2 null/void? Does marriage void the visa? We would not be immigrating, still only visiting.

Are you marrying a US Citizen?

The visa isn't completely "void" until it is revoked by CBP, ICE, or the DOS--or until it expires. However, if you marry a US citizen, it would be very difficult to use thereafter.

No, I am a USC my SO holds a tourist visa. We will not marry in US - and sooner or later marry here, overseas. After marriage is the visa null? I do not understand - may be difficult to use. It is either good or not and why do you state it MIGHT be? Would they be thinking my SO would be coming to states to what? Stay and work? Well they have the residence, should be easy enough to find us. Please restate your concerns and or some evidence would be great. Thanks.

No, the tourist visa is not rendered void. She should bring strong ties to home, and better yet, you should bring your ties abroad to show you two are not planning on moving to the US when you take a trip.

Every person entering the US is assumed to have immigrant intent. Your spouse traveling to see her/your family in the US would raise the interest/suspicion of the CBP officer.

It is up to the foreign national to prove they have strong ties to home. Marrying a US citizen shows strong ties to the US.

Just coz of the marriage visa does not get null, does not matter where you marry in US or out of US.

Wht other poster means is once you are married it will be difficult for your spouse to use her B1/2 to gain entry into US.

CBP officers dont like ppl entering on B1/2 when they are married to USC, as it can be mis-used to enter and the file for AOS which is kinda circumventing the actual process.

If you are able to show enough proof to CBP officer you and your spouse are only visiting and would return back they might let your spouse enter US on B1/2.
