information about priority date

  1. 1. what happen if im 21 year old now but my acceptance in inmigration say under 21 that will change my category in the visa bulletin?

Your priority date became current in 2010. I hope your case is completed at NVC before December 31,2010 whereby your CSPA age is locked up. This is probably what your friend is referring to. But your information is still short. How long was your petition ( I-130) got approval from USCIS? This is critical on your age.

how did u get the 31 dec 2010 date?? kindly explain..because vb first retogressed in jan 2011..as jan 2011 vb is 1jan08..then feb 2011 vb is 1jan08 ...again retrogression in march... as march 2011 vb is 1jan07..

please correct me if i'm wrong..

The OP's priority date is May 25, 2009. The petition was approved August 3, 2010. The priority date became current the following month, and remained current until January, 2011. Although the OP turned 22 in January, 2011, he hadn't aged out yet because he could deduct more than one year that the petition approval was pending. Presuming NVC had his petition by that time, his age would have been frozen when the cutoff date retrogressed.

So Sirach123's post is very relevant, and my previous post may have been wrong. The OP might not have aged out yet.

I just simplify to the point the retrogression effect for him because his PD was already affected in January 2011. In other words it is a cut off date to have his case completed otherwise he has age out already.

Where did you get 12/01/2008? Obviously, if you enter a visa bulletin date which is half a year before the petition was submitted then you'll easily qualify.

Your priority date was current (initially) September 1, 2010. On that day your CSPA age was about 20 years, 5 months. The visa bulletin retrogressed in January, 2011. Your priority date is no longer current, but if NVC received your petition after September 1, 2010, then your age should have been frozen. When your priority date becomes current again you should be able to qualify for an F2A.
