The I-130 visa for my wife was approved on 09/12/06, while my K-3 VISA has not been approved yet. I prefer the k-3 than the I-130. My question is how can i delay the I-130 processes so that it does not get to the embassy in Nigeria ahead of the K-3 VISA, the receipt date for the K-3 IS 06/22/06 last touch was on 07/10/06.Valid inputs and advice would be highly appreciated. Furthermore i want to thank everyone who had made this site a resourceful location, your valid inputs/questions and answers has made family reunion possible across cultures, countries and embassies. Thank you all.

Why do you prefer the K3? If the I-130 comes first, it's generally preferred - your wife will have a green card when she enters the country. Also, my understanding is that once the approved I-130 arrives at the consulate they will cancel the K3 if it arrrives later.

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

I agree with RIBLET , why wait for the K3 when you already have the 130 approved??? but to answer toy your question , the approved 130 will not continue its process at NVC unless you pay the required documents such as DS230 and 864.

it takes long for the consulate to schedule an interview that is why. it usually takes 6-8month to get an interview date minus the time it would take to complete the case here in the U.S. /NVC .The case has not been sent to the consulate yet, not even the the NVC. I only have the e-mail notification on SEPT 13. I'm yet to get the official letter from the USCIS OFFICE.

Point of clarification: your wife does not have an approved visa. She has yet to apply for a visa. However, she does now have permission to apply for an immigrant visa.

you can delay it as much as you want, by just not replying to their letters when they send the fee bills.

You can wait on the K3 to be completed, and then you can continue on with the I-130 stuff and return to Nigeria for the CR1 interview, or you can have NVC transfer the stuff to your district office and she can apply for AOS after she arrives.
