Cr-1 Visa Tips & Advise

Hi All,

Hope all are doing good.

I am an Indian male working in uk married to a American women 5 yrs elder to me (Indian born) in a Caribbean country. We have been lived together for only 4 days after marriage. Now am back to uk and she is in USA. She is planning to apply for Cr-1 visa to get me there to USA. I have few questions need to be clarified.

* Assume I-130 is a first step and we can get all details from guide, what are the additional evidences needed apart from marriage certificate, considering the fact that we are living separately.

* Can I attend my visa interview in UK although hold indian passport.

* My parents not happy with marriage will not get any support from them will it be an issue during any stage?

* I have two visa rejections before (h1b - 221g blue form, embassy required additional document but my employer couldn't submit, tourist visa when applied from uk before i fly to carribbean to get marry. does it have any implications on my petition? if yes, how can i prepare for it?

* Any other advise you guys would suggest me? She well settled over there, so not ready to move permanently to uk or india.

Also told in my tourist visa just going to visit usa as tourist , didn't mention anything about her.

1- It doesn't matter that you are not living together, after all it is the point in asking for a CR-1 visa isn't it? You will need to prove that you have an ongoing marital union. This is needed for the I-130 but it will also be needed for the interview so while you wait to get approved for your I-130 you can accumulate a few more proofs... They require only one, but i think send everything you have... What we have sent: Chat logs, phone logs, joint bank account proof, a proof that i'm the beneficiary on my husband's life insurance, pictures of us together, a copy of plane tickets used to visit each other, receipt from hotel you lived at together... Well you get the point.

2- I have no idea if you can attend your visa interview in the UK being Indian... I'm tempted to say yes because wherever you are in the world it is still a US consulate and the point is having your interview in the country you are living in. But I am not sure so you will have to ask someone else about that.

3- I'm guessing you have the age of majority if you are married. Your parents have nothing to do in this story. The only thing with which they could help you is if they would sign affidavits to certify of your marital union with your wife (to use as proof of your ongoing marital union for your I-130 and interview) but you can find plenty of other things to send so i would say no, your parents won't be an issue.

4- On the I-130 form, there is the question ''has your relative ever been under immigration proceedings?'' you will need to answer that one correctly. I don't think it will be a problem at all. But at the interview, bring proofs of those. Why you were rejected and all.

5- You can get married in the US on a tourist visa - it's not really an issue. As long as you were not planning to get married or you do not intend to stay after (that's where the immigration process comes handy...)

My last advice is that you should take your time, gather all the documents you need, make sure to not forget anything and read the forums regularly... everything should be fine :thumbs:

From what I understand you are a resident in the UK....if this is the case, then yes you can.

The address of the foreign spouse in I-130 is the factor to decide the visa consulate. So take care of that in your I-130 petition and you will get a consulate accordingly.

For example, NVC gave me a wrong consulate (Mumbai) as they could figure out the state my wife from the address provided in I-130. So I called and got that changed to the right consulate (Chennai) and while doing that they relied only on where my wife stays abroad, as per I-130.

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

It will have to be your UK address. It is your US spouse that needs to update the address change online when there is address change. here is the link.

You don't have to change anything till the DS-230 time (all correspondence will be done through email). You use the new address in your DS-230, filed with NVC after the I-130 petition has been approved.
