Do you know why this person says that they got RFE'd because they didn't have the actual TB skin test abroad?

Can you explain the "new TB rules?" Or, for that matter, the old ones? I had never heard of something like that.. maybe it was old. I just don't know. Thanks :)

I got an RFE for TB skin test at the AOS interview. I had the (negative)x-ray, but no skin test as I got the BCG shot as a baby which can make it positive. Sure enough my skin test came back positive. I sent it back and got my green card - they just needed to check the box, already knowing I don't have TB but making me get the test anyway. Cost me an extra $50 and much headache.

(sorry you didn't quote me so I didn't get notified --- and I don't usually keep track of where i posted :P)

Well I suppose the rules are technically old now (2008) but because it says "update" they treat it like it's gospel... here it is: http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextchannel=68439c7755cb9010VgnVCM10000045f3d6a1RCRD&vgnextoid=1758d5b07655b110VgnVCM1000004718190aRCRD basically some CS's are still taking this to mean EVERYONE needs a TB skin test, even those who have a valid K1 medical when this isn't true (trust me on this, I had an I-693 transcription done, they tried to get me to do the TST and I said no and accepted their ultimatum of if I was RFE'd for it they would charge me again and guess what.. approved with no RFE :P). If you scroll down there's this Q&A:

No. Applicants who are not required to have the entire medical examination need to submit only pages one, three and five of the new form. The required sections include Part 1, Information About You, the vaccination record portion of Part 2, and Part 5 (if the vaccinations are administered by a civil surgeon) or Part 6 (if the vaccinations are administered by a local health department). Pages two and four, that would have been left blank, do not need to be submitted.

You can see there is NO mention of someone in this situation (who is basically a K1) having the TB test as well.

I would say that person was RFE'd for the same reason some people in 2009/2010 were RFE's for missing medicals, drone error. Basically the drones that process your package have a checklist. They don't see a medical in your AOS package when you're a K1 because your medical is in your A file, something they didn't know so they immediately RFE you for the missing medical then you'd have to make an INFOPASS and tell them to check your A file. Happened a LOT last year. Enough that I asked the doc in Aus to send me a copy of my medical to pre-empt the "dreaded medical RFE". Seems their checklist has been updated now though.
