I-130 Form

I did say which question I am answering but to be more specific its question 21 from section c.

The correct answer is "none". If you have never lived in the US, then it's none. N/A would mean the question didn't apply to you, but the question does apply.

Early in the Ajudicator's Field Manual, this issue is addressed. It states clearly that putting "N/A" in these types of cases is a "common ploy" to cover something up that *is* applicable.

Thus, in this case, "none" would be the most desirable answer legally, but all three answers discussed here will ultimately make them aware of the same thing: they have not lived together.

You can read this in the adjudicator's field manual on uscis.gov.

I am not trying to cover up just trying to fill out the form correctly, because i know depending on how i answer the question they will require evidence. Our relationship has always been long distance he moved home for a short period but we didnt pay bills from a joint account or paid rent. i live at home with my parents and when he visits he stays over or is by his parents house. So technically we have never lived together.

Line 21 does not specify address in U.S., I used my wife's address in China on my I-130, technically you have lived together ( at your parents home) the line does not ask whether you own the residence or not, they are asking at what address you lived together at. When he visits, you and him live together at your parent's address. If you need evidence have your parent's prepare an affidavit stating he stays there when he visits.

The correct answer is none, b/c you stayed in the same building during a visit doesn't consitute as living together. Please read the document and interrupt it correctly.

I was addressing the OP regarding her situation, I did not say that the question asked her if she ever lived in the US. I was giving the OP an example for her situation.

If he was staying at the Motel 6 at night and going to his wife's parent's home everyday. I would say he was visiting, but since they apparently share a bed there and spend time together there, I would say living there. I am sorry I am not quite sure what amount of time spent together is required to make the transition from just visiting to living together. I could understand your response better if they were filing DCF and having to meet the 6 month rule, but I do not see why his wife can not use her parent's address since she lives there full-time.

I will just put none, all his trips are visits. Living is totally different and when we got married he had to leave to go back to work. So technically we have not lived together as a married couple as yet. Thanks for the help.
