I'm truly sorry for your pain. :( Although, and your heart is shattered into pieces, please try to think of it as a blessing,his true colors were shown now, rather than few years down the road, when you had kids together, which would of complicated things even more.

I agree with everyone. Giving into his demand, would cause you legal headaches in the long run. Why give him rewards for being a bad boy? Turn the page, start a new chapter in your life. Once you get the money he owes you, either send it back to USCIS, or just burn the darn GC :yes:

First of all Im so sorry for your misfortune, like you said no one gets married to get divorced, although life still goes on, even after a divorce. I also agree with returning the green card to USCIS... He walked out on you and refused to make it work, why would you even consider sending it over to him...im just saying...I can only imagine the heartbreak your enduring, hold your head up hun and keep it moving. His green card arrived AFTER he left to go home. He's requesting I send it to him. Do I wait for money from him first to pay off the rest of the debts he had me incur on OUR behalf? I'm doing my best not to be emotional, but I don't like being abandoned after my best efforts have been put forth out of love.

You can't hold his GC so if you don't want to send it to him, tell him you returned it to USCIS with a note that he left before receiving it.

I notice from your timeline he didn't apply for AP so double check the approval date of the GC. If it's AFTER he left, let USCIS know he abandoned the process. No idea what they'll do about it but do NOT entertain thoughts of blackmail, do NOT mock him about it or tease him about it. Just be matter of fact about it. "returned to sender, you left and abandoned your status".

I certainly would not send it to USCIS some doofus there might mail it to him.

Why take the chance?

Because it sounds like she's already told him she got it. Opening his mail is a federal offence. Holding onto his GC is also illegal. Why should SHE take the chance?

Agree with everyone, just wanted to add to not let him try some mental tricks and tell you that you have to send it to him or you are breaking the law. I could see him trying to use that angle. Jim, even though he left prior to receiving the physical greencard, I thought your passport stamp was the substitute?? Am I wrong here?

What passport stamp? He arrived with a K1 visa and applied for AOS. If he left before the AOS was approved, and didn't have advance parole (haven't got word on this yet from the OP) then he abandoned his AOS application. USCIS would revoke the approval of his green card because of this.

Several comments advocating illegal activities have been removed. Please remember that it is a violation of TOS to advocate or support any sort of illegal immigration activity.

The OP has received good advice to return the card to USCIS with the note that her husband left the US on xxx date, that the marriage has fallen apart and she is filing for divorce,and that his current address is XXXXX in Australia. If he is still considered valid to receive the green card, then USCIS can send it to him (eg he left with Advance Parole), and if he left without AP, then he has abandoned the AOS petition and USCIS will keep the green card.

Although we all sympathize with your situation, you are compelled to return the issued "green card" to USCIS with an explanation. We would all agree that sometimes relationships don't work out, but USA immigration benefits should not be allowed for this example of exploitation. Do the right thing here and press on.

I was abandoned myself in January this year and this is what I did.

1. Call in a report to I.C.E at 1-866-347-2423 Tell them you believe he married you just to get a green card. Be prepared they will want to know things like Alien number, Passport number , Drivers licence number, last known address, birthdate, birthplace,SS# etc.

Give them whatever info you have available on him. Tell the agent you have his green card and follow the agents instructions, trust me they will tell you exactly what to do. DO NOT follow the instructions from people in a forum on the internet . Remember this effects your life not theirs.

2.The I.C.E agent will then tell you to prepare a written statement with supporting documents if you have any and send them to your local U.S.C.I.S field office.

Immigration fraud victims website has a section in it on how to prepare and mail statements.

3.In my case the I.C.E agent instructed me to meet with an immigration officer at the local field office.

To do this you go online to http://infopass.uscis.gov/ there you can make an appointment with an immigration officer.

I hand delivered the statement with supporting documents to the immigration officer and also sent it registered mail with signature required.

4. Make copies of everything and write down name of immigration officer you spoke with.

You have already stated he does not work so if he returns he may end up on the welfare role.

This may effect you being his sponsor so please try to protect yourself.

My final word of advice is stay completely away from him no contact whatsoever.

You say he married you got approved for green card then left sure sounds like fraud to me.

What you are going through is heartwrenching

In my own case I have been so relieved that I turned everything over to the authorities and have this behind me now.

Where does it say that he married her only for a Greencard? That's obviously not the case if he left the country before he got it.

OP - I am very sorry you're going through this. I remember him posting last time, and I am especially sorry to hear his doubts weren't mutual. My heart goes out to you.

Since he left country I believe U.S.C.I.S may no longer consider this to be a bona fide marriage

He's dating someone on facebook now, and apparently she loves him. Good luck with that!! lol

I'm not going to be bitter about this, and my decision to return his card is not out of anger, but out of the responsibility and duty as an American citizen to do what is right and let them know what is going on. I won't bend anymore rules, of my own or anyone else, for him. It's actually quite a freeing feeling :)

You sound like you really have your act together. Head screwed on straight. Vindictiveness is a waste of time and you are focusing on doing positive things to extricate yourself.

It is of interest to people here, and relevant to you, whether he left before his green card was approved, and if not, whether he had advanced parole. Because that makes all the difference Tuesday. They are going to know of course, but please let us know.
