Hi, everyone, i just got married and my husband is a US citizen. I am an F1 student just graduated and currently on OPT.

My husband just graduated also and got the job in March 2011, and it is actually a part-time job, so his income is insufficient to sponsor me on I 864. Therefore I asked my uncle to be my sponsor.

My question is,

1.so my husband AND my uncle both need to file I-864 for me, right?

2.But my husband just started the job and does not have tax return, what should i do?

3.and what should i put on the# Q 25 on the form?

Thank you very much!!!!!

Yes. Both your spouse and Uncle must fill out an I-864. As far as your husbands earnings, use his most recent tax returns. Regarding this year with the part time pay, use all of his pay stubs or a year to date to help. But I strongly advise you to double check any answers you get from us by calling your consulate! If you miss something or fill it out wrong, it could set you back months. But at least you have somewhere to start :D. Good luck to you. Oh and for Q#25, just fill in the returns that he does have. Maybe the year before or before or before. Anything can help.

Husband and uncle both need to complete an I-864.

If your husband did not have to file any past tax returns due to not earning enough income, then leave question 25 blank.

The instructions say: "If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation."
