Applying AOS from OPT Marrying to Divorced Spouse

Hi All,

I am currently on OPT and married to divorced spouse.I am applying for AOS in US.I need help with tax documents in support of I-864.

My Spouse filled jointly for the taxes for 2 years and recent year separately.In support of form I-864 it asks for recent 3 years tax returns.

Is it ok to submit the jointly filled tax returns with previous married conditions ??

Yes. However, 3 years are not strictly required. You have a choice between sending only the most recent year, or the last three years.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
