if your not married yet, then you file the 1-129f for k-1 visa fee340.00...i don't think you will get a refund, from the fee you sent 420.00,.. the 1-130 is for if your married cr-1.. wait and see what happens next, or call the 1-800 number.

It looks like your confused about the whole process and judging from your lack of knowledge i would say you didnt send any supporting documents and you only sent the I-130 and I-129F forms, is this correct?

If i were you i would read the guides section http://www.visajourney.com/content/guides and familiarize yourself with the process. I would also call USCIS to see if they can withdraw your I-130 petition or what the next step for you should be.

If i am correct about you not including any other forms for example G-325A or any other paperwork i would suspect your petition will be either denied or you will get RFE for more information.

Hello can anyone tell me what is a affidavit of support and when I need to send because it was not with my fiance visa pkt..I never filled out that paperwork for that ..Please help..I hope this doesnt prolong our process for the visa..Noa 1 2 june ..still waiting on approval letter thanks

Your I134 will go with to the embassy, that is where you swear legally to support.

yeah, if you're not married and you wanted to bring you fiance to you so that yall could get married in the States- thats I-129F. .. I-130 and I-129F basically have the same kind of imformation on it, but the petition is not the same. and the filing fee for fiance is $340, not $420.

i would obviously -call

get the right paper filled out and make sure you sent all the other right things to go with the I-129F (g-325A ****make sure it's not the G-325, passport pics, letters of intent, evidence.. etc). did you already send all that too?

Yes i sent all that paperwork as well. I hoppe they will process this. All documents for i 135 were turned in

They will probably reject your petition, because of the wrong filing fee- even though it's too much, rather than too little! As they cannot do a partial refund. However, you really, really need to call them asap- today! and get a second tier human/ supervisor to let you know what exactly is going on. And then go to that "nice and helpful" lady on case and explain to her that she messed up hugely. Was this just some lady you met, or an official US military person?

Unfortunately, based on what you wrote in this topic, I'd tell that most likely your petition will be denied and you will need to re-file everything, because you sent wrong petition. Yes, I-129F and I-130 look similar, but it's absolutely different petitions. You filed I-130, and it's family-based petition for your spouse. So I see two variants:

1) USCIS will send you RFE to send proof of marriage (marriage certificate) from date before filing petition, and since you haven't one, after RFE will expire, your petition will be rejected;

2) your petition will be rejected because you're not married yet and they will see it by supplements.

I don't think it's even possible to turn I-130 to I-129F or get your money back after getting NOA-1 (USCIS payments are non-refundable). Sorry, but I would withdraw I-130 ASAP and re-file I-129F. I heard about opposite case, when Russian couple filed I-129F and then got married before NOA-2 (why? I don't know). They couldn't turn I-129F to I-130 in the middle of processing and they needed to re-file I-130 and start everything from the beginning.

And read carefully all instructions before doing next paperwork, I can see you mixing petitions, because you writing about I-295 (what is it?) I-135 (what is it again?)... I agree with Mike. I would call the 1-800 number and ask if you can withdraw your petition as the wrong petition has been submitted. Once you get the packet back, READ READ READ the Guides link at the top of this page and familiarise yourself with the CORRECT process for fiance .. ie, I-129f and K1 (fiance/e) visa. Ultimately, it's quicker to withdraw and start again, than wait for them to realise that you're not married and they have the incorrect documents to be able to proceed.

The sooner you do it, the sooner you can start the right process. I'd give that "helpful advisor" a wide berth in future, if this is the best information she could provide. The process itself is easy enough, provided you educate yourself on what to expect throughout the whole cycle of your immigration path. Most people on VJ have done their own paperwork, and the vast majority of us have done it successfully the first time, or with minor RFE's. You can do this. :)

Yes Yes Yes I submitted today my own paperwork..Luckily I had copies of the packet I had sent back in June. It had the i-135 and a 1-130 . So what I sent today was I redid the cover sheets and letter of intent paperworks with new dates and notarys and I sent the i-135f...both g-325A Passport Photos..copies of both birth certificates..emails..pics..reciepts all all..Like I said it was all originally in the first pkt so all i did was redo some paperwork. So I sent today and I hope to have answer in the next 5 months..what do you think..I really hope sooner but who knows..Both me and my fiance are very upset and sad that we have to wait even longer now.

Did you withdraw the original petition? It may cause further problems if you just send another set of paperwork.

What is the " i-135f."? Did you mean to type I-129F?

I hope you sent payment?

How were you able to get a new letter of intent from your fiancee so quickly?

You should definitely hear something before 5 months, but the entire process takes longer than that.
